Terms of Service

Effective Date: January 1, 2023

This Website located at castlerockinsurance.com (the “Website”) is owned and operated by Castle Rock Insurance LLC, a Colorado limited liability company (“Castle Rock Insurance,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Website.

By accessing or using the Website, you acknowledge that you have read, understand, and agree to be bound by these Terms. If you do not agree, you must not use the Website.

Permitted Use and Eligibility

  • Eligibility: You must be at least eighteen (18) years of age to use the Website. By using the Website, you represent that you meet this requirement.
  • Permitted Use: The Website is provided for informational and referral purposes only. You may not use the Website for any unlawful, misleading, or unauthorized purpose.
  • Limited License: Castle Rock Insurance LLC grants you a limited, non-exclusive, revocable, and non-transferable license to access and use the Website in accordance with these Terms.

Regulatory Status and Scope of Services

Castle Rock Insurance LLC operates as an insurance marketing, referral, and coordination platform. Castle Rock Insurance LLC is not an insurance carrier and does not underwrite, bind, issue, amend, or service insurance policies.

We work with a network of independent, appropriately licensed insurance professionals and select exclusive partners. Most requests submitted through the Website are referred to one of these partners for follow up. Any insurance advice, coverage recommendations, quoting, underwriting, binding, surplus lines placement, and policy servicing are provided solely by the licensed insurance professional that receives the referral and not by Castle Rock Insurance LLC.

Nothing on this Website constitutes insurance advice, a binder, a quotation, or a contract of insurance.

Surplus Lines Disclosure

Some insurance products discussed or referenced may be placed with non-admitted insurers through licensed surplus lines brokers in accordance with Colorado law. Non-admitted insurers are not licensed by the Colorado Division of Insurance and are not protected by the Colorado Insurance Guaranty Association.

All surplus lines placements are handled exclusively by properly licensed surplus lines producers and are subject to applicable state statutes and required disclosures at the time of placement.

User Submissions and Accuracy

You are responsible for the accuracy and completeness of all information you submit through the Website. Submission of information does not obligate any licensed agent or broker to provide a quote or place coverage.

Castle Rock Insurance LLC does not guarantee insurance availability, eligibility, pricing, limits, or coverage terms. These items are determined by the licensed insurance professional and the insurer.

Intellectual Property

  • Ownership: All Website content including text, graphics, logos, images, layout, design elements, and software is owned by Castle Rock Insurance LLC or its licensors and is protected by applicable intellectual property laws.
  • Restrictions: No content may be copied, reproduced, modified, distributed, published, displayed, or used for commercial purposes without prior written consent from Castle Rock Insurance LLC.

Privacy and Data Use

Your use of the Website is subject to our Privacy Policy. By using the Website, you consent to the collection, use, and disclosure of information as described in that policy, including the sharing of information with licensed insurance professionals for referral purposes.

Third-Party Websites

The Website may include links to third-party websites or services. Castle Rock Insurance LLC does not control and is not responsible for the content, accuracy, or practices of third parties. Access to third-party sites is at your own risk.

No Warranties

The Website and all content are provided on an “as is” and “as available” basis. Castle Rock Insurance LLC disclaims all warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and availability.

Limitation of Liability

To the maximum extent permitted by law, Castle Rock Insurance LLC and its members, managers, officers, employees, and agents shall not be liable for any damages arising out of or related to your use of the Website, reliance on Website content, or any referral to a licensed insurance professional.

Indemnification

You agree to indemnify and hold harmless Castle Rock Insurance LLC from any claims, losses, liabilities, damages, or expenses arising from your use of the Website or violation of these Terms.

Dispute Resolution and Arbitration

Informal Resolution First: Before starting a lawsuit or arbitration, you agree to contact us at [email protected] and provide a brief description of your issue and the relief you are seeking. We will attempt to resolve the dispute informally.

Binding Arbitration: If a dispute is not resolved informally within thirty (30) days, you and Castle Rock Insurance LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Website will be resolved by binding arbitration, rather than in court, except as stated below. Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, as applicable, and will be conducted in Colorado unless you and we agree otherwise.

Exceptions: Either party may bring an individual claim in small claims court if the claim qualifies. Either party may seek temporary injunctive relief in a court of competent jurisdiction to preserve rights or property pending completion of arbitration.

Individual Basis Only: Arbitration will proceed only on an individual basis. You and Castle Rock Insurance LLC waive the right to participate in a class action, class arbitration, or representative action against the other.

Fees: Payment of arbitration fees will be governed by the AAA rules. If you cannot afford arbitration fees, you may request that the AAA reduce or waive fees under its consumer rules.

Severability: If any portion of this arbitration section is found to be unenforceable, the unenforceable portion will be severed and the remainder will be enforced to the fullest extent permitted by law. If the “Individual Basis Only” paragraph is found unenforceable, then the arbitration section will be void only as to that paragraph and all other terms will remain in effect.

Changes and Termination

  • Updates: Castle Rock Insurance LLC may modify these Terms at any time. Changes are effective when posted. Continued use of the Website means you accept the updated Terms.
  • Access Termination: We may suspend or terminate access to the Website at our discretion for violations of these Terms or misuse of the Website.

Governing Law and Venue

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. To the extent a dispute is permitted to proceed in court, exclusive venue will be in state or federal courts located in Colorado.
